Dave & Buster’s, a popular entertainment chain known for its vibrant arcade games and family-friendly atmosphere, has recently introduced Betting that’s causing quite a stir. In collaboration with Lucra Sports, the company aims to allow customers to place bets on arcade games through a specialized app.

This innovative approach, designed to enhance customer engagement and increase spending, is not being met with universal applause.

Betting: Regulatory Challenges and Legislative Pushback

The initiative has swiftly attracted the attention of regulators and lawmakers. In Illinois, State Rep. Daniel Didech has been particularly vocal about his concerns. As the chairman of the Illinois House Gaming Committee, Rep. Didech filed legislation aimed at prohibiting wagering in family amusement centers. He emphasized that such establishments are not equipped to manage gambling activities safely and responsibly, criticizing the plan for not having adequate safeguards for problem gamblers and for potentially exposing minors to gambling.

Rep. Didech’s bill, which enjoys bipartisan support from over two dozen lawmakers, seeks to amend the Illinois Criminal Code to make such activities illegal. “It is inappropriate for family-friendly arcades to facilitate unregulated gambling on their premises,” Didech stated, expressing his determination to advance this legislation.

Legal Implications Beyond Illinois

The proposal has also caught the eye of the Ohio Casino Control Commission, which expressed serious concerns about the legality of the scheme. According to a spokesperson, the plan could contravene Ohio laws that regulate skill-based amusement machines. The Commission has reached out to Dave & Buster’s for more details, indicating that the scrutiny is far from over.

Corporate Silence and the Bigger Picture

Both Dave & Buster’s and Lucra Sports have refrained from commenting on the backlash. However, Lucra has highlighted that the peer-to-peer betting system utilized in their app is considered skill-based and thus falls outside the stringent regulations that govern traditional sportsbooks. They also mentioned having responsible gaming policies in place, such as options for users to self-exclude or impose limits on their betting.

Industry Expert Weighs In

Brett Abarbanel, from the University of Nevada, Las Vegas International Gaming Institute, shared her curiosity about the potential consumer protection measures Dave & Buster’s might implement. “Regardless of the legal classification of the activity as ‘not gambling’ vs. ‘gambling,’ this is an activity where participants are risking something of value on an uncertain outcome. There should be consumer protection measures in place for players,” she noted, highlighting the importance of safeguarding especially younger players.

Balancing innovation with responsibility will be crucial for Dave & Buster’s as they navigate the complexities of integrating gambling with arcade fun.
